Representation of the Title Industry
We advise title companies regarding compliance with both state and federal requirements. State law issues include Maryland Insurance Administration compliance, MAHT account compliance, licensing, escheat, and leasing issues, as well as the employment, human resources, and banking issues attendant to operating a title business. Federal compliance includes RESPA compliance, TILA compliance, and Gramm-Leach-Bliley/Safeguards compliance, in addition to general federal labor compliance. Our RESPA experience includes an extensive knowledge of the current case law, HUD interpretations, and industry trends pertaining to affiliated business arrangements, reissue rates, and other key issues.
We also have significant experience litigating on behalf of or in defense of title companies. The sheer volume of transactions handled by title companies and their relative complexity in many cases leads to litigation. We have successfully defended title companies against contract claims, misrepresentation claims, negligence claims, and other plaintiffs’ claims. Bouland & Brush has also successfully prosecuted civil claims for moneys improperly taken or withheld from title companies. We have also taken an advisory role in RESPA class-action litigation, leading to an acceptable settlement of that class-action litigation.
